The formalities

What formalities must you accomplish upon starting an assignment?

Registering with Social Security:

  • We cannot register you with Luxembourg's Social Security unless we are in possession of a copy of your valid identity card.
  • Upon issuing you with your contract, Adecco Luxembourg registers you with Luxembourg's Social Security in order to open up your rights.
  • In order to be able to consult a doctor or get medicine from a pharmacy, you must apply for your health card from Luxembourg's Caisse Nationale de Santé (CNS) or at www.cns.lu.
  • Please retain this card carefully. The card number is personal and will remain the same throughout your working life in Luxembourg.

Please note: people who work in Luxembourg and live across the border can benefit from health care both in the Grand Duchy of Luxembourg and in their country of residence. In order to claim these rights in your country of residence, you need to apply for an E106 form (BL1 form for Belgian citizens) by writing to CNS in Luxembourg. You will receive this E106 certificate a few weeks later. You must then send it to your insurance company in your country of residence. You must repeat this procedure systematically whenever your assignment is extended, whenever taking up a new assignment or whenever your status changes!

N.B.: your letters or faxes to CNS must set out:

  1. Your full name
  2. Your Luxembourgish Social Security number or date of birth written backwards (year + month + day)
  3. Your address
  4. The name of your employer (ADECCO, in the present case)
  5. The start date of your contract

For the purposes of registration with the Tax Authorities (Administration des Contributions), you need to provide us with the following:

Once you have accomplished all the formalities shown below, you will receive, within a month of your registration, a tax retention form which you must immediately forward to us.

Please bring us your filled in and signed tax retention form together with the following:

  • a) In the case of workers living in and commuting from France:
    • If single and with no dependent children: a copy of your identity card signed and certified as authentic.
    • If living as a couple with one or more dependent children:
      1. a recent proof of address (EDF electricity or telephone bill)
      2. a recent certificate (maximum 1 month old) delivered by the Caisse Nationale des Prestations Familiales certifying that you receive child support payments for your child or children. If you fail to provide this certificate, you will be treated as single and will have to modify your card upon receiving the document
      3. your live-in partner's declaration
      4. the birth certificate(s) of your child or children - the birth record in your livret de famille is not sufficient.
    • If married, separated, divorced, widowed or a single parent with one or more dependent children: a copy of your identity card and a copy of your livret de famille, signed and certified as authentic.
  • b) In the case of workers living in and commuting from Germany:
    • Your "Haushaltsbescheinigung", which is available from the local authority of the municipality where you live.
  • c) In the case of workers living in and commuting from Belgium:
    • Your Composition de Ménage, which is available from the local authority of the municipality where you live.
  • d) For residents of Luxembourg:
    • Contact the local authority of the municipality where you live for your Tax Retention Form.
  • If you have already worked in Luxembourg this year, you will need to have your Tax Retention Form handy and forward it to us without delay.

PLEASE NOTE: Under Luxembourg's tax laws, we have to withhold 33% tax from your wages until we receive your Tax Retention Form. It is therefore in your interest to let us have this as soon as possible. You must re-register with Administration des Contributions yearly.

Medical examination:

In accordance with article L. 224-3.1. of Luxembourg's Code du travail [labour laws] and in accordance with article 14.1 of the collective contract for temporary workers, should you fail to turn up for a medical examination scheduled by the occupational health body without giving Adecco at least 24 hours' notice of a valid excuse, your employer is entitled to deduct a fixed fine of 80.00 euros from your wages.

Any failure to show up to a medical examination twice in a row without a valid excuse is considered gross misconduct warranting the immediate dismissal of the temp involved.

Your assignment contract and your presence:

We will send you two copies of your assignment contract upon each start or renewal of an assignment. You should sign and return 1 copy to us within 2 days.

By selecting you to work on an assignment with one of our clients, ADECCO assumes a number of responsibilities towards that client. We guarantee our client a solution to a staff shortage at their company. We depend on and are counting on you to deliver this solution. You must therefore comply stringently with the contract that you signed with ADECCO. Your punctual attendance at work is an absolute must.
